Title: Establishes Timely Competency Evaluations and Restoration Services to Persons Suffering from Behavioral Health Disorders
a vote to concur with house amendments and pass a bill that establishes competency evaluations and restoration services to individuals Suffering from behavioral health conditions in the state of Washington.
Requires that persons in jail who suffer from behavioral health disorders have the right to timely competency evaluations and restoration services (Sec. 1).
Prohibits jails and juvenile detention centers from prohibiting an antipsychotic prescription, except for the following reasons (Sec. 12):
The generic name and brand name are chemically the same;
Drug recall or removal from the market; and
Evidence indicating no therapeutic help.
Authorizes a pilot project in which the University of Washington to provide short-term stabilization while awaiting a trial (Sec. 14).
Authorizes that depending on funds, the health care provider shall receive an increase in compensation in out-patient restoration programs (Sec. 15).
Requires jails to allow clinical intervention when a security and background check have been completed (Sec. 17).
Requires the clinician completing the evaluation to provide a report to the court (Sec. 20).
