Highlights:

  • Increases criminal penalties for fentanyl trafficking and possession to the following, including (Sec. 1):

    • For selling or possessing between 42-100 grams of fentanyl charged with a low-level trafficking B felony offense with subsequent penalties; and

    • For selling or possessing between 100-400 grams of fentanyl charged with an A felony offense with subsequent penalties;

  • Prohibits individuals from intentionally misrepresenting another controlled substance as fentanyl and specifies violators shall be guilty of a category B felony and subject to subsequent criminal penalties (Sec. 1).

  • Requires local law enforcement agency submit a report to legislature each year before either March 1, or October 1, documenting certain information regarding individuals charged with trafficking illegally manufactured fenanyl (Sec. 1).
