Title: Increases Criminal Penalties for Fentanyl Trafficking and Possession
Vote to pass a bill that increases criminal penalties for fentanyl trafficking and possession.
Increases criminal penalties for fentanyl trafficking and possession to the following, including (Sec. 1):
For selling or possessing between 42-100 grams of fentanyl charged with a low-level trafficking B felony offense with subsequent penalties; and
For selling or possessing between 100-400 grams of fentanyl charged with an A felony offense with subsequent penalties;
Prohibits individuals from intentionally misrepresenting another controlled substance as fentanyl and specifies violators shall be guilty of a category B felony and subject to subsequent criminal penalties (Sec. 1).
Requires local law enforcement agency submit a report to legislature each year before either March 1, or October 1, documenting certain information regarding individuals charged with trafficking illegally manufactured fenanyl (Sec. 1).
Specifies that the provisions of this bill shall take effect immediately upon passage and approval by the governor (Sec. 14).
