Title: Authorizes Homeless Individuals who Committed Misdemeanors to be Deferred to a Specialty Court Program
Vote to pass a bill that authorizes individuals experiencing homelessness who committed misdemeanors to be deferred to a diversion or specialty court program.
Authorizes eligible defendants including individuals experiencing homelessness who committed misdemeanors to be deferred to a diversion or specialty court program (Sec. 4).
Authorizes a court that assigns an individual to a diversion or speciality court program to waive or reduce any fine, adminstrative assessment, or fee that would otherwise be imposed upon the homeless individual for committing a misdemeanor offense (Sec. 5).
Expands the definition “eligible defendant” to include individuals suffering from mental illness or substance abuse or has an intellectual disability and would benefit from assignment to a speciality court program (Sec. 8).
Specifies that the provisions of this bill shall take effect upon passage and approval by the governor (Sec. 13).
