Title: Prohibits Gender Affirming Care for Minors

Vote to override a governors veto and pass a bill that prohibits gender affirming care for minors.

Highlights:

  • Prohibits any health care professional from engaging in any of the following acts in attempt to alter a minor’s appearance to validate a minor’s perception of their sex, if their perception is different from the minor’s sex (Sec. 1): 

    • Prescription or administration of hormones or drugs used to block a hormone receptor or used to suppress or delay puberty;

    • Hormone prescription or administration in greater amounts than would be normally produced in a healthy individual of the same age and sex;

    • Performance of sterilization surgeries;

    • Performance of any surgery that artificially constructs the appearance of genitalia that differs from the minor’s sex;

    • Removal of any healthy or non-diseased body part or tissue; and 

    • Performance of augmentation mammoplasty or any other aesthetic surgical procedure.

  • Authorizes the above provisions of healthcare under the following circumstances, including (Sec. 1):

    • The minor being born with medically verifiable sex development disorders including but not limited to external ambiguous sex characteristics and sex steroid hormone production which is normal for a biological female or male;

    • The minor needing treatment for infection, injury, disease, or disorder caused by any act prohibited by this bill; or

    • The minor suffers from a physical disorder, injury, or illness that would put them in danger of death or physical impairment unless surgery is performed.

  • Specifies that if a healthcare professional initiates course of treatment of a minor including administration any drug or hormone prohibited by this act and the healthcare professional determines immediately terminating the minor’s use of the drug would cause harm, then the healthcare professional may institute a period where the drug is systematically reduced and discontinued before December 31, 2024 (Sec. 1).

  • Specifies that the provisions of this bill shall take effect January 1, 2024 (Sec. 3).

NOTE: A TWO-THIRDS MAJORITY OF MEMBERS ELECTED IS REQUIRED TO OVERRIDE A GOVERNOR'S VETO.
