Highlights:

  • Requires that a vehicle hauling the following be permitted a 10% variance from the weight limitations within a 150 mile radius of the point of origin and outside of nonattainment areas, provided that the tractor and trailer are certified to meet or exceed the weight allowable by the variance (Sec. 1):

  • Agricultural or farm product from a farm to the first point of marketing or processing;

  • Agricultural finished goods for distribution or retail sale and purchase by consumers;

  • Recovered materials from ints of generation to a processing facility.

  • Prohibits a lift axle from being used to compute the maximum total gross weight authorized (Sec. 1).

  • Requires any person who violates the load limitations by exceeding a 10% variance be fined on the basis of the weight limitations of this subsection (Sec. 1).

  • Specifies that this paragraph is to be repealed on July 1, 2025 (Sec. 1).

  • Establishes damage compensation guidelines for gross weight, single axles, and tandem axles without a lift (Sec. 2).

  • Establishes damage compensation guidelines for when total gross weight is greater than allowable for a bridge (Sec. 2).

  • Authorizes local law enforcement the ability to issue a citation or warning to the owner or operator of any vehicle violating weight limitations (Sec. 2).
