Vote to amend and pass a bill that amends and clarifies when hotels can refuse service to individuals.

Highlights:

  • Authorizes a proprietor or manager of a hotel to refuse admission, service, or accommodations to a person who (Sec. 10):

    • While on hotel’s premises, destroys or threatens to destroy hotel property, or causes or threatens to cause a public disturbance; or

    • Is seeking accommodations for the unlawful possession or use of a controlled substance, or for the consumption of alcohol by a person under the age of 21.

  • Authorizes a proprietor or manager of a hotel to remove a person from the hotel if they (Sec. 11):

    • Refuse to pay for services;

    • While on hotel’s premises, destroys or threatens to destroy hotel property, verbally or physically threatens employees or guests, or causes or threatens to cause a public disturbance;

    • Is using accommodations for the unlawful possession or use of a controlled substance, or for the consumption of alcohol by a person under the age of 21;

    • Violates any state, federal, or local laws;

    • Violates a hotel rule that is clearly posted near the front desk or online; or

    • Uses verbally abusive language towards staff or guests.

  • Requires that, if the guest has paid in advance, for the hotel manager to tender to the guest any unused portion of their payment at the time of removal (Sec. 11).

  • Prohibits this section from being used to discriminate against a guest on the basis of characteristics protected under state, federal, or local law and does not limit any rights that a guest may have under state, federal, or local anti discrimination or civil rights laws (Sec. 11).

  • Prohibits a hotel manager from removing a guest while the location of the hotel is located under a severe weather warning without a verbal or written warning (Sec. 11).

  • Defines ‘severe weather warning’ to mean a warning  issued by the National Weather Service for a tornado, severe thunderstorm, flash flooding, or a winter storm (Sec. 11).

  • Prohibits this section from being used to terminate a month-to-month, early, or any other term lease of a permanent resident (Sec. 11).
