Vote to adopt a conference report and pass a bill that amends laws regarding retention of records in public schools.

Highlights:

 

  • Defines ‘administration’ to mean the Indiana Archives and Records Administration (Sec. 1).

  • Requires that the administration does the following (Sec. 1):

  • Establishes procedures to retain original records in an electronic format;

  • Establish a period of time after which an original record may be destroyed after it is in an electronic format;

  • Prepare and submit a report to the general assembly in an electronic format, not later than November 1, 2023, regarding the procedure established on transferring records to electronic formats and the required time period before original records may be destroyed.

  • Requires that, no later than July 1, 2024, the Early Learning Advisory Committee commissions a third party evaluation to assess existing regulations for childcare providers and provide recommendations to (Sec. 3):

  • Maintain health and safety standards;

  • Streamline administrative burdens, program standard, and reporting requirements for child care providers;

  • Provide flexibility for child care providers with a level 3 or 4 paths to QUALITY program rating to expand to other locations;

  • Assist accredited K-12 institutions in establishing and providing high quality onsite child care and early learning programs.

  • Requires that, no later than December 31, 2023, the Committee develops recommendations for implementing a revised paths to QUALITY program that (Sec. 3):

  • Maintains health and safety standards;

  • Integrates objective measures of kindergarten readiness;

  • Contemplates accredited kindergarten through grade 12 institutions as onsite providers and;

  • Incentivizes child care providers to increase wages for child care workers who complete education and training that results in a postsecondary degree or industry recognized credential.

  • Requires that the department establish and maintain on their website, a public database of information provided by each school, concerning employees of each public school who were physically injured while on the job by students (Sec. 27).

  • Requires that the department provide for each school year the following information to each elementary school (Sec. 28):

  • The pass rate for reading skills, ILEARN for language arts, and ILEARN for math;

  • Student chronic absenteeism rate;

  • The per student funding determined by the department.

  • Requires that the department provide for each school year the following information to each high school (Sec. 28):

  • The average composite SAT score for enrolled students;

  • The graduation rate;

  • The graduation rate excluding students that receive a waiver;

  • The percentage of all students enrolled who passed an advanced placement exam, international baccalaureate exam, dual credit course, or a Cambridge International exam.

  • Requires that, no later than October 15, 2023, each year the schools post the information provided by the department onto their websites homepage (Sec. 28).

  • Requires each public school to provide to the department, information concerning employee injury while on the job by a student if the injury (Sec 33):

  • Is required to be reported by the schools worker’s compensation carrier;

  • Causes the employee to miss all or part of 1 or more work days or;

  • Is required to be reported to the school pursuant to the school’s reporting policy.

  • Prohibits information that identifies the employee or student from being provided (Sec. 33).

  • Requires a school superintendent to inform all governing members of the body within 5 business day, if they conclude an investigation that may result in termination of an employee or become aware of any possible criminal activity that involves a current or former employee and (Sec. 34):

  • May have occurred on school property or at a school event or activity;

  • May have involved a current or former student.

  • Requires a school corporation to have teacher compensation be no less than 62% of state tuition support distributed to the school corporation (Sec. 37).

  • Authorizes  any course that meets the requirements of a career and technical education program to be taught virtually if (Sec. 41):

  • The program of study results in an industry recognized credential;

  • The course was approved by the state board;

  • All instruction required to be in person is conducted through an employer provided work based learning program or a career and technical education center.

  • Requires that the department consider using the following metrics when developing a proposal for a revised school performance designation (Sec. 45):

  • The number of students with work based learning experiences in grades 9 through 12;

  • The percentage of students in a graduation cohort that earned a credential of value;

  • The percentage of students earning each diploma type;

  • The percentage of students who indicate their intent after graduation to join the military, pursue employment, begin an internship or apprenticeship, or attend a 2 or 4 year postsecondary educational institution.
