Title: Amends Safety Measures and Prohibits Unfair Contract Terminations for Exotic Dancers
Vote to pass a bill that amends safety measures and prohibits unfair contract terminations for exotic dancers.
Specifies that adult entertainment is not defined as sexual conduct (Sec. 1-4).
Requires each adult entertainment establishment to develop training and train employees in first aid and conflict de-escalation (Sec. 4).
Requires each adult entertainment establishment to have at least one person dedicated to club security during business hours (Sec. 4).
Defines Adult Entertainment Nightclub (Sec. 4).
Specifies that in order to meet qualifications as an adult entertainment nightclub, an establishment must have the following (Sec. 4):
Has written processes and procedures for responding to criminal activity and ejecting customers violating club rules;
Provides a customer complaint log;
Provides the department with annual proof of compliance and maintenance records for panic buttons;
Locker rooms and dressing rooms with keycodes to enter;
Displays signage concerning rules regarding tips.
Specifies that adult entertainment establishments may not charge fees for employees (Sec. 5).
Specifies that for non-employees an establishment may not charge a fee that is more than 30% of the fees collected by the performer, carry on unpaid balances, charge fees for late appearances or for late payment (Sec. 5).
Specifies that establishments may not control the following (Sec. 5).
How much an entertainer charges;
When and how the entertainer works;
What type of clothing they are to wear;
Take adverse action on the entertainer based on scheduling;
Other controlling actions.
Specifies that fees must be stated in a written contract (Sec. 5).
Specifies that if one part of the act is invalid the rest shall remain valid (Sec. 7).
