Title: Amends State Definition of a Public Transit Employee
Vote to pass a bill that amends the state definition of a public transit employee.
Defines a confidential employee to mean a person who, in the regular course of the person's duties (Sec. 1):
Assists in acts in a confidential capacity in relation to other persons who determine management policies regarding labor relations;
Has authorized access to information relating to effectuating or reviewing the employer’s collective bargaining policies.
Defines a managerial employee to mean a person who is engaged in executive and management functions, as well as charged with the responsibility of overseeing the effectuation of management policies and practices (Sec. 1).
Defines a supervisor to mean a person who has authority in the interest of the employer to (Sec. 1):
Hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward, or discipline other employees;
Adjust another employee’s grievance or recommend action against another employee’s grievance.
Specifies that a supervisor does not include a person who is of a routine or clerical nature and does not require the person to use independent judgment (Sec. 1).
Defines employee to mean an individual employed by an employer but does not include a person employed as a supervisor, managerial employee, or confidential employee (Sec. 2).
Defines employer to mean a person that employs an employee (Sec. 2).
