Highlights:

  • Defines chauffeur as a person employed full time or on a regular basis, including leased drivers, for the purpose of operating a motor vehicle (Sec. 1).

  • Defines political subdivision as a city, village, town, or county (Sec. 2).

  • Authorizes a political subdivision to enter into a written agreement with the owner of a private road or driveway located within a manufactured and mobile home community in order to enforce traffic regulations, or local ordinances in conformity with these regulations, on the private road or driveway (Sec. 4).

  • Authorizes a political subdivision the ability to authorize a law enforcement officer to impound a vehicle used in the violation of a local ordinance at the time of issuing a citation for the offense if (Sec. 5):

    • Has a prior conviction for a violation; or

    • The penalty has not been fully paid.

  • Authorizes the ordinance to provide for impoundment of the vehicle until the penalty of the previous citation has been paid and for reasonable towing costs of impounding the vehicle, including towing and storage costs (Sec. 5).

  • Requires that a political subdivision return the vehicle to its owner upon payment of the amount required under the ordinance (Sec. 5).

  • Authorizes the political subdivision to dispose of the vehicle if the vehicle remains unclaimed for more than 90 days after the disposition of the citation for which the vehicle was impounded (Sec. 5).
