  • Requires that by January 1, 2029, and every 3 years thereafter, the Department review the maximum acceptable global warming potential for each category of eligible materials and to adjust them to reflect industry conditions (Sec. 1).

  • Prohibits the department from adjusting the global warming potential upward for any category of eligible material (Sec. 1).

  • Requires that for any solicitation of a contract for an eligible project, the State must specify the eligible materials used and the reasonable minimum usage threshold (Sec. 2).

  • Requires a successful bidder of an eligible project to submit for each eligible material proposed to be used in the project (Sec. 2):

    • A current environmental product declaration; and

    • A life cycle assessment method that includes uniform standards in data collection.

  • Prohibits a contractor from installing any eligible materials until they submit a facility-specific environmental product declaration for that material (Sec. 2).

  • Requires that the contractor notify the State and use alternative material if an environmental product declaration is not available for an eligible material (Sec. 2).
