Title: Authorizes Second Chance Certification for Disqualified Truck Drivers

Vote to pass a bill that authorizes second chance certification for disqualified commercial truck drivers.

Highlights:

  • Authorizes individuals who have received lifetime bans from commercial driving privileges to reapply for reinstatement of commercial driving privileges  on a case by case basis (Sec. 1). 

  • Specifies that they must accomplish the following in order to do so 

    • A completed rehabilitation program if they were found to be impaired while driving; 

    • An approved driver improvement course; 

    • Pay a restoration fee; 

    • Meet all requirements under the law to hold a commercial driving licenses; 

    • They shall not have been convicted of a felony or misdemeanor for ten years prior 

    • They shall meet court set requirements for reinstatement; 

    • At least ten years have passed since the initial termination of license. 

  • Specifies that the following individuals are barred from being reinstated (Sec. 1): 

    • Individuals who have committed a felony with their vehicle;

    • Those who have been charged with human trafficking. 

  • Specifies that individuals looking to be reinstated have to submit an application over mail and include proof of the requirements stated above (Sec. 1). 

  • Specifies that if a person commits a felony They shall receive a permanent lifetime disqualification from commercial driving (Sec. 1).
