  • Authorizes the individual sale of home baked goods to expand economic activity in the state 

  • Specifies that the Departments of Labor and Agriculture may not prohibit a food establishment retailer located in a residential dwelling, including food establishments licesed as a domestic kitchen from selling food on the basis that there are pets in the residential dwelling (Sec. 1). 

  • Defines “retailer” as an individual who engages in the business of selling consumer goods to retail buyers (excluding restaurants) and including, but not limited to, the following (Sec. 1):

    • Coffee shops; and

    • Packaged food, including:

      • Baked good;

      • Confectionary items;

      • Coffee beans;

      • Teas;

      • Popcorn;

      • Jams;

      • Jellies;

      • Honey;

      • Syrup;

      • Fruit;

      • Butter;

      • Nut mixes;

      • Repackaged freeze-dried foods;

      • Repackaged dried and dehydrated foods; and 

      • Powdered drink mixes.

  • Specifies that this bill shall take effect immediately upon passage and approval by the governor (Sec. 1).
