Title: Amends Various State Gun Control Laws

A vote to Pass a bill establishing new statutes and laws concerning fire-arms

Highlights:

 

  • Authorizes penalties for possession of weapons without serial numbers including a fine of $1000 for the first offense, $6250 for the second offense, and $250,000 for the third offense with corresponding penalties of 1 year and 10 year imprisonment for first and third offense respectively (Sec. 1).

  • Prohibits a person from owning a firearm unless it comports with federal law concerning serial numbers (Sec. 4).

  • Specifies that this does not apply to the following items (Sec.  4):

    • Antique Weapons; 

    • Weapons manufactured prior to 1968;

    • Firearms rendered completely inoperable 

    • The sale, offer to sell, or transfer of a firearm to, or possession of a firearm by, a person licensed as a firearm manufacturer, importer or dealer (Sec. 4).

    • A gunsmith taking possession of a firearm for the purpose of imprinting the firearm with a serial number in accordance with federal law.

  • Specifies that a violation of the above constitutes a Class B violation or a class A violation if there is a prior conviction on record (Sec. 4).

  • Specifies that a person convicted under this section must surrender all firearms (Sec. 4). 

  • Prohibits an individual from importing into the state an unfinished firearm receiver or frame (Sec. 5). 

  • Specifies that the above will not apply if the individual is a licensed weapons dealer, the serial number is conspicuously placed on the weapon, and records are kept concerning the transaction (Sec. 5). 

  • Specifies that a person under the age of 18 is not prohibited from possessing the following firearms (Sec. 6) 

    • An unfinished firearm frame or receivers or one of the below firearms; 

    • A single shot rifle; 

    • A repeating rifle; 

    • A rifle with a tubular magazine capable of firing .22 ammunition;

    • A muzzleloading rifle;

    • A shotgun with a pump, revolver, break, or lever action; 

    • IF they were transferred a firearm from a family member or guardian;

  • Specifies that the above does not apply for Trained peace officers, service members, or other qualified individuals (Sec. 7).

  • Specifies that nothing in the above sections prohibits the keeping of firearms in a locked vehicle (Sec. 10). 

  • Authorizes cities to develop independent regulations concerning concealed-carry firearms (Sec. 12). 

  • Specifies that an individual is not prohibited from transferring a firearm to a service member, peace officer, or other qualified individual (Sec. 15). 

  • Establishes that this act declares an emergency (Sec. 20).
