Title: Amends State Law to Close Previous Loophole in Reporting Juvenile Mental Health Hospitalizations

Highlights:

  • Amends Texas statutes to read 16 years of age and intellectual disability instead of mental retardation when referring to federal prohibited person information (Sec. 1). 

  • Specifies that the statutes refers to a child who is at least 16 years old and meets the following criteria (Sec. 1): 

    • Found unfit to proceed due to mental illness or intellectual disability; 

    • Found not responsible for conduct due to mental illness or intellectual disability;

    • Ordered by the court to receive inpatient care at a mental health facility; and

    • Committed by the Court to a residential care facility. 

  • Specifies that the statutes also refer to an adult person whom the court has appointed a guardian to for the purposes of the persons lack of mental capacity to manage their affairs (Sec. 1). 

  • Establishes that the Clerk of Court shall forward a signed court order containing federal prohibited person information to the department for an auditing process of information provided to the FBI  for the purposes of the National Instant Criminal Background Check System (Sec. 2).

  • Specifies that if the department receives incomplete or invalid information then they may notify the Clerk of Court and have them forward any other information about the person not included (Sec. 2).
