Title: Authorizes Sports Gambling and Horse Racing
Vote to pass a bill that authorizes sports betting and horse racing in the state.
Authorizes participating in sports wagering as defined in the Article (Sec. 1).
Specifies that the Article does not apply to sports wagering on tribal lands (Sec. 1).
Establishes the following events are not authorized for sports wagering (Sec. 1):
The occurrence of injuries;
The occurrence of penalties;
The outcome of disciplinary proceedings; and
The outcome of replay reviews.
Specifies the Article does not apply to fantasy games where the knowledge of each player and accumulated statistical performances determine the outcome (Sec. 1).
Specifies the following rules for engaging in sports betting (Sec. 1):
Any person under 21 is not authorized to participate;
Any person who has been prohibited by law from participating, is not authorized to participate; and
Any participant of the sporting event is not authorized to participate in sports wagering for that event.
Establishes a license for accepting or offering sports wagers with the following application steps (Sec. 1):
Licensing fee of $1,000,000;
Submit a proposed business plan and internal controls; and
Submit a written information security program.
Establishes the following criminal and civil penalties for violating the Article (Sec. 1):
The suspension or revocation of a sports wagering license;
A monetary fine of no more than $10,000 for each violation;
A Class 2 misdemeanor for engaging in in sports wagering in violation;
A Class 2 misdemeanor for anyone under the age of 21 engaging in sports wagering;
A Class G felony for conspiring to influence the outcome of an event that has been wagered on; and
A Class I felony for providing false information on a sports wagering license.
