Title: Requires School Employees Who are Under Criminal Investigation To Be Put On Paid Leave

Vote to pass a bill that requires paid leave for school employees under investigation.

Highlights:

  • Requires that if a school board has an ongoing investigation into a faculty member accused of a crime against a minor that it must take the following actions (Sec. 1):

    • The faculty member will be placed on extended administrative leave with the reason of the leave being confidential; 

    • The faculty member will be allowed to return if an investigation concludes without criminal charges or does not return a conviction 

    • Further employment action including but not limited to leave without pay and termination of contract; and

    • The faculty member will pay back all compensation from the paid leave unless it is an unpaid leave of absence. 

  • Specifies that nothing in this section will prohibit a school district from imposing extra penalties including termination due especially if it is based on the following (Sec. 1). 

    • A violation of work policies; 

    • A violation of local school board policies 

    • A violation of ethical, moral, or professional conduct;

    • insubordination;

  • Specifies that if the actions taken by the faculty member amounts to a fireable offense then the school district may terminate the employee and stop paid leave (Sec. 1). 

  • Specifies that this act will go into effect if 2/3rds of the legislature approve with or without governor approval (Sec. 1).
