Title: Establishes Requirements for Law Enforcement Use of Voluntary DNA Databases
Vote to pass a bill that establishes requirements for law enforcement use of voluntary DNA databases.
Establishes certain requirements for law enforcement agencies in order to use voluntary DNA profile databases including the use of only use third-party DNA specimens for (Sec. 1):
Identifying a possible suspect;
Exonerate a possible suspect; or
Identifying a missing or unknown individual.
Defines “DNA profile” as the patterns of fragments of DNA used to identify an individual (Sec. 2).
Defines “ genetic information” as data acquired from an analysis of a DNA spcimen (Sec. 2).
Limits types of arrests and charges based on certain types of genetic information and use of genetic information (Sec. 2).
Specifies various procedural requirements for retention and destruction of certain types of genetic information and remedies for certain law enforcement investigation violations (Sec. 2).
Requires law enforcement agency reporting for certain investigative genetic geneology database utilizations (Sec. 2).
Establishes certain provisions concerning postconviction relief involving an investigative genetic genealogy (Sec. 2).
Requires the State Commision on Criminal and Juvenile Justice receive, compile, and publish data concerning certain law enforcement genetic genealogy utilizations (Sec. 3).
