Title: Increases Anti-Hazing Laws
Vote to concur with house amendments and pass a bill that increases criminal felony penalties for hazing.
Increases criminal penalties for hazing in the first degree resulting in serious bodily injury or death to a minor or student to a Class D felony (Sec. 2).
Increases criminal penalties for hazing in the second degree (not resulting in serious bodily injury or death) to a Class A misdemeanor (Sec. 2).
Defines “hazing” as a direct action which substantially endangers the physical health of a minor or student for the purpose of initiation into, affiliation with, or enhancing or maintaining membership or status within any organization (Sec. 1).
Defines “organization” for the purposes of this bill as a number of individuals who are associated with a school or postsecondary education, including (Sec. 1):
Student organizations;
Fraternities;
Sororities;
Associations;
Corporations;
Order;
Society;
Corps;
Clubs; or
Similar group.
Exempts the following groups and authorizes them as a reasonable defense under this bill, including (Sec. 2-3):
Interscholastic or intercollegiate athletic practices, competitions, or events;
Law enforcement training; or
Military training.
Specifies that this bill shall take effect March 27, 2023 upon passage and approval by the governor (Sec. 5).
