Title: Prohibits Gender Affirming Care for Minors and Human Sexuality Education in Elementary School

Vote to override the governors veto and pass a bill that prohibits gender affirming care for minors and human sexuality education in elementary school.

Highlights:

  • Requires public schools to notify parents regarding health services and mental health services related to human sexuality, contraception, or family planning available at the student's school and request that parents give consent or decline any of those services but shall not waive the requirements for education or health records (Sec. 1). 

  • Requires that as part of providing a safe and supportive learning environment a school shall notify a student's parents if the school changes health services related to human sexuality, contraception, or family planning when receiving medical or mental health services (Sec. 1).

  • Requires the school district to respect the rights of parents to make decisions regarding the upbringing or control of their student when it relates to mental health, physical health, or life issues, and shall disallow the Kentucky Board of Education from making policies regarding keeping records confidential from parents unless they believe that doing so would protect a child from abuse and neglect, policy or procedures regarding preferred pronouns that do not conform to a students biological sex, or the usage of a students preferred pronouns by a school district (Sec. 2). 

  • Requires that prior to a well-being questionnaire or medical assessment that a school allow parents access to the material with the intent of  reviewing it and giving consent (Sec. 2).

  • Specifies that nothing in this act will prohibit a student from receiving emergency medical or mental health care (Sec. 1). 

  • Prohibits students from learning about human sexuality and sexually transmitted diseases prior to sixth grade and only with parent consent through curriculum or programs on human sexuality or sexually transmitted diseases authorized in this section (Sec. 2).

  • Prohibits students from receiving any instruction that has the goal or purpose of students learning about gender identity or sexual orientation (Sec. 3).

  • Requires that schools who provide instruction on human sexuality must provide students whose parents did not consent to alternative materials and must be reviewed to ensure they are developmentally appropriate (Sec. 3). 

  • Requires public schools offering curricula and materials on sexuality and human development must inform parents 2 weeks in advance (Sec. 2).

NOTE: A SIMPLE MAJORITY IS REQUIRED TO OVERRIDE A GOVERNOR'S VETO.
