Title: Increases Penalties for Robbery & Organized Retail Crime

Highlights:

  • Specifies that shoplifting consist of one of the following acts (Sec. 1): 

    • Willfully taking merchandise from a store without paying;

    • Willfully hiding merchandise with the intent of taking it without paying for it; 

    • Willfully altering a label, price tag or marking upon merchandise with the intention of lowering the price of said merchandise; and/or  

    • Wilfully changing the container a merchandise comes in with the intention of lowering the piece of said merchandise. 

  • Classifies shoplifting as a petty misdemeanor when the value shoplifted is $250 or less (Sec. 1). 

  • Classifies shoplifting as a misdemeanor when the value shoplifted is between $250-$500 (Sec. 1). 

  • Classifies shoplifting as a fourth degree felony when the value shoplifted is between $500-$2,500 (Sec. 1). 

  • Classifies shoplifting as a third degree felony when the value shoplifted is between $2,500-$20,000 (Sec. 1).

  • Classifies shoplifting as a second degree misdemeanor when the value shoplifted is more than $20,000 (Sec. 1). 

  • Specifies that aggravated shoplifting is assaulting or striking at another with a deadly weapon immediately after an act of shoplifting in order to keep hold of the stolen merchandise (Sec. 1). 

  • Classifies aggravated shoplifting as a third degree felony (Sec. 1).

  • Specifies that the following acts are organized retail crime (Sec. 2): 

    • Working in contention with one or more person to steal merchandise with a value of $2,5000 or more over the span of a year with the intention to sell, exchange or return the merchandise for value;

    • Working in contention with one or more person to  receive, purchase or possess merchandise with a value of $2,500 that they know to be stolen; 

    • Acts as an agent of another person to steal teal merchandise with a value of $2,500 or more over the span of a year; or 

    •  Recruits, coordinates, organizes, supervises, directs, manages or finances anybody to commit the above actions. 

  • Classifies organized retail crime as a second degree felony (Sec. 2).
