Title: Requires Safe Firearm Storage, Background Checks on Unlicensed Gun Sales and Extreme Risk Protection Orders

Vote to pass a bill that requires safe firearm storage, background checks on unlicensed gun sales and extreme risk protection orders.

Highlights:

 

  • Requires that a person wanting to lawfully own, possess, carry, or transport as a pistol a firearm greater than 26 inches in length must (Sec. 1): 

    • Register the firearm;

    • Maintain that registration; and 

    • Possess a valid license for the gun.  

  • Prohibits a person from purchasing, carrying, possessing, or transporting a pistol in the state of Michigan without first obtaining a valid license (Sec. 2).  

  • Prohibits a person from purchasing, carrying, possessing, or transporting a firearm that isn’t a pistol without first obtaining a valid license (Sec. 2). 

  • Requires that someone who is on leave from active duty with the Armed Forces or has been discharged from active duty with the Armed Forces shall obtain a license for their firearm no later than 30 days after their arrival in Michigan (Sec. 2). 

  • Requires that those authorized to give out gun-licenses give them out with due speed and diligence to those qualified (Sec. 2). 

  • Specifies that the following qualifies someone to have a licensee (Sec. 2): 

    • The individual has not received or been subjected to an order or disposition that entered them into the law enforcement information network;

    • The individual is 18 years of age or if the firearm is a pistol the individual is over 21 years old; 

    • The individual is a legal residence of the United States;

    • The individual does not have any felony charges being processed against them;

    • The individual has not been adjudged insane in the state or elsewhere; and 

    • The individual is not under an order of involuntary commitment in an inpatient or outpatient setting due to mental illness.

  • Requires that the licensing authority electronically enter the information into the pistol entry database no later than 10 days 10 days after receiving the license copy for a pistol (Sec. 2).  

  • Classifies making a material false statement on gun-licensing documents as a felony punishable by imprisonment for not more than 4 years or a fine of not more than $2,500 or both (Sec 2a).
