Highlights:

 

  • Defines “gender-affirming care” as psychological, behavioral, surgical, pharmaceutical, and medical care, services, and supplies to provide support to an individual’s gender identity (Sec. 2).

  • Defines “public body” as a state or local government, advisory board, commission, agency, or entity created by the state constitution or any branch of government (Sec. 2).

  • Defines “reproductive health care” as psychological, behavioral, surgical, pharmaceutical, and medical care, services, and supplies, including services related to (Sec. 2): 

    • Preventing a pregnancy;

    • Abortion;

    • Managing a pregnancy loss;

    • Prenatal, birth, perinatal, and postpartum health;

    • Managing perimenopase and menopause;

    • Managing firtility;

    • Treating cancers of the reproductive system; or

    • Preventing or treating sexually transmitted infections.

  • Prohibits a public body from directly or indirectly denying, restricting, or interfering with an indviduals ability to access gender-affirming care (Sec. 3).

  • Prohibits a public body from discriminating against an individual based on their use or refusal to use reproductive health care services (Sec. 3).

  • Authorizes a court to assess a civil penalty of up to $5,000 in damages for individuals found to have violated the aforementioned provisions of this bill (Sec. 4).
