Title: Prohibits Gender-Affirming Care for Minors

Vote to pass a bill that prohibits gender-affirming care care for minors.

Highlights:

  • Classifies providing one or more gender transition services to a person under 18 by a healthcare provider as unethical and unprofessional conduct that proves they are unfit to do their job and grounds to discharge them from their responsibilities (Sec. 2). 

  • Requires all licensing or certifying agencies for health care providers to (Sec. 2): 

    • Investigate any report that a licensed provider has performed gender transition services to someone under 18; and 

    • Revoke the provider's license if reports are found to be true. 

  • Requires a state, county, city, local government, special district, or any department, agency, or instrumentality thereof to (Sec. 2): 

    • Investigate any report that a publicly funded health care provider has performed gender transition services to someone under 18; and 

    • Terminate the public funding of said provider if the report turns out to be true. 

  • Prohibits public funds from being granted to or either directly or indirectly used by any organization that provides gender transition services to those under the age of 18 (Sec. 4). 

  • Requires that no healthcare provider owned, operated, or employed, directly or indirectly, by the state, county, city, local government, special district, or any department, agency, or employee or instrumentality thereof provide gender transition services to those under the age of 18 (Sec. 4). 

  • Authorizes the attorney general to intervene and enforce that no gender transition services are done to a person under 18 (Sec. 5). 

  • Prohibits any healthcare provider owned, operated, or employed, directly or indirectly, by the state, county, city, local government, special district, or any department, agency, or employee or instrumentality thereof from intervening with any legal proceedings brought to challenge this act (Sec. 5). 

  • Prohibits the Department for Medicaid Services and any managed care organization contracted to provide Medicaid or Kentucky Children's Health Insurance Program benefits from reimbursing, covering, or providing benefits for gender transition services for those under 18 (Sec. 6).
