Vote to amend and pass a bill that amends name, image, and likeness (NIL) language in previous state law.

Highlights:

  • Authorizes a certificate of registration and its process for athlete agents (Page 6). 

  • Establishes the grounds for denial of registration as the following (Page 10-11):

    • Stating false, misleading, deceptive, or fraudulent claims of being an agent;

    • Engaging in conduct prohibited by Section 3313;

    • Having a former registration revoked or denied by any state; and 

    • Engaging in conduct that reflects the applicant’s credibility.

  • Prohibits athlete agents who commit certain offenses such as (Page 11-13):

    • Any offense of a controlled substance;

    • Any violent offense relating to murder, rape, and indecent assault;

    • Any offense relating to stalking, harassment, prohibited weapons, and theft;

    • Any offense relating to extortion, rigging a contest, endangering children, and incest;

    • Any offense of bribery in official matters, rioting, perjury, gambling, and pool selling; and

    • Any offense involving exhibition of deformed persons, corrupting minors, and sexual abuse of children.

  • Establishes fees for registration and renewal for athlete agents (Page 15-16).

  • Establishes agency contracts must contain the following (Page 16-17):

    • The amount to be paid by a student athlete;

    • A description of the expenses that the student athlete agrees to reimburse;

    • A description of the services provided;

    • The duration of the contract;

    • The date of execution; and

    • The student’s signature.

  • Authorizes student athlete’s the following warnings (Page 17):

    • Loss of eligibility to compete as a student athlete in a specific sport;

    • Requirements to tell the athletic director withing 72 hours; and

    • Cancellation of the contract within 14 days of signing.

  • Authorizes students to void contracts that do not fit the requirements in Section2 (Page 17).

  • Establishes that a student athlete retains their records up to five years (Page 18). 

  • Establishes civil litigation against an athlete agent for violations (Page 20).

  • Authorizes severability for the sections from the act (Page 59).
