Highlights:

  • Establishes that anyone who causes bodily harm to another person who they know is a firefighter, national guard member, or a commission warden shall be guilty of a class H felony (Sec. 1).

  • Specifies that sheriffs and police officers have a duty to suppress unlawful assemblies within their jurisdiction and call for all members of the assembly to disperse (Sec. 3).

  • Defines a “riot” as public disturbance involving unlawful assembly which consists of any of the following (Sec. 4):

    • An act of violence by one or more persons of the unlawful assembly that would result in damage of property or injury to another person;

    • A threat to commit an act of violence by one or more persons of the unlawful assembly that would result in damage of property or injury to another person; or

    • An act of violence by at least one or more persons of the unlawful assembly that substantially obstructs law enforcement or another governmental function. 

  • Establishes that a person enrolled or employed by an institution may be additionally or alternatively sentenced to up to 6 months suspension from the institution (Sec. 6).  

  • Specifies that involvement in a riot can result in misdemeanor or felony penalties depending on the extent of that person’s involvement (Sec. 7).
