Title: Requires Informed Written Consent be Given by Individuals Seeking an Abortion Prior to the Procedure
Vote to pass a bill that requires informed written consent be given by individuals seeking an abortion prior to the procedure taking place.
Defines “informed written consent” as the knowing and voluntary written consent to abortion by a pregnant individual of any age, without undue indcement or any element of force, fraud, deceit, duress, or other form of constraint or coercion by the physician (Sec. 1).
Specifies that informed written consent given to a pregnant individual shall include the following information, including, but not limited to (Sec. 1):
A full medical explanation of the nature, benefits, and risks of the proposed procedure;
An instruction that they may withdraw consent at any time prior to the procedure;
An offer that the pregnant individual may speak with the physician or authorized nurse practitioner performing the procedure to answer questions; and
A statement of the probable gestational age at the time of the abortion at that a fetal ultrasound be performed to confirm at the pregnant individual’s request.
Exempts informed written consent from being needed in cases of a medical emergency or spontaneous miscarriage (Sec. 1).
