Vote to pass a substitute bill that prohibits certain firearm carry for persons serving probation.

Highlights:

  • Establishes that it is unlawful to possess in one’s immediate control, in operation of a vehicle or riding as a passenger, or at one’s residence, any pistol, imitation or homemade pistol, altered air or toy pistol, machine gun, sawed-off shotgun or sawed-off rifle, or any other dangerous or deadly firearm, if one falls into any of the following categories (Sec.1):

    • A person who is a convicted felon;

    • A person who is subject to supervision, probation, parole or inmate status;

    • A youthful offender who committed a crime that would be considered a felony as an adult; or

    • A person who is unlawfully in the United States.

 

  • Establishes that any person who was convicted of a nonviolent felony and has received a  full and complete pardon from the proper authority shall have restored the right to possess any firearm or other weapon (Sec. 1).

  • Specifies that knowingly or intentionally allowing a convicted felon, adjudicated delinquent, or a youthful offender to possess or control a firearm is punishable by a fine of up to $5,000 and a handgun license revocation (Sec. 1).

  • Specifies that any convicted or adjudicated person violating the provisions of this bill shall, upon conviction, be guilty of a felony (Sec. 1).
