Title: Amends State Constitution in Regard to Bail

  • Amends the state constitution to prohibit bail before a conviction if the following occurs, including (Sec. 1):

    • For capital offenses;

    • For other felony offenses when the following applies, including:

      • The proof is positive or the presumption great;

      • The proof is clear and convincing that no combination of conditions will assure court appearance or the publics safety.

  • Authorizes friends and counsel to, on reasonable conditions, have access to the accuses individual before conviction (Sec. 1).

NOTE: THE LEGISLATION'S ENACTMENT CLAUSE REQUIRES AN AFFIRMATIVE VOTE OF 2/3 OF THE CHAMBER'S MEMBERS FOR PASSAGE.
