Title: Reduces Penalties for Possession of Marijuana
Vote to pass a bill that reduces penalties for possession of marijuana.
Classifies possessing one ounce or less of marijuana as a Class C misdemeanor, rather than a higher order misdemeanor (Sec. 1).
Requires police officers to give citations for low-level marijuana possession offenses instead of initiating arrests (Sec. 2).
Authorizes criminal record expungement for low-level marijuana possession offenses if (Sec. 3):
The offense was dismissed more than 180 before or the person charged was acquitted;
The person charged with the offense makes a written request; and
The person charged with the offense pays a $30 fee.
Requires the court to inform the defendant of their expunction rights if a low-level marijuana possession claim is dismissed (Sec. 4).
