Title: Establishes Worker Protections for Warehouse Workers

    • a work standard which an employee is assigned or required to perform at a specified productivity speed, or a quantified number of tasks, or produce a quantified amount of material within the defined time period; or

    • An employee’s actions are categorized between time performing tasks and not performing taks and the employee’s failure to complete a taks performance standard or recommendation may have and adverse impact on the employee’s continued employment or the conditions of such employment.

  • Prohibits warehouse companies from requiring their warehouse employees meet a quota that prevents compliance with meal or rest periods, or use of bathroom facilities, including reasonable travel time to and from bathroom facilities (Article 21-A, Sec. 780).

  • Prohibits warehouse companies from taking adverse action against a warehouse employee who fails to meet a quota that not allow compliance with the aforementioned requirements (Article 21-A, Sec. 780).

  • Prohibits warehouse companies from taking adverse action against an employee that fails to meet a quota that has not been disclosed to them (Article 21-A, Sec. 780).

  • Authorizes warehouse worker employees to file a complaint alleging employer violations with the commissioner of any local, state, or federal government agency or official and specifies the state attorny general as having the authority to prosecute actions, either civilly, or ciminal (Article 21-A, Sec. 780).
