Title: Establishes Legal Process for Wrongful Conviction Compensation
Vote to pass a bill that establishes a legal process for wrongful conviction compensation.
Authorizes a person to petition for compensation for wrongful conviction if (Sec. 1):
They were imprisoned as a result of their conviction;
The charges were dismissed or the person received a gubernatorial pardon; and
They did not commit the crime with which they were charged.
Requires petitioners found to be wrongfully convicted to be awarded (Sec. 1):
$65,000 per year of imprisonment;
$25,000 per year served on parole; and
The value of all legal fees the petitioner paid for both the petition and the original litigation.
Requires a wrongful conviction petition to be filed within 2 years of the dismissal of the charges in order to be valid (Sec. 1).
Requires a notice of petition to be filed within 180 days of the dismissal of the charges in order for the subsequent petition to be valid (Sec. 2).
