Title: Requires Gender Pay Equity

Vote to adopt a conference report and pass a bill that requires gender pay equity in all workplaces.

Highlights:

 

  • Prohibits any employer from paying an employee a wage at a rate less than the rate they pay the opposite sex in the same establishment for equal work on a job, the performance of which requires equal skill, education, effort, and responsibility (Sec. 3).

  • Exempts payment based on seniority, merit, or a system that measures earnings by quantity or quality of production (Sec. 3).

  • Requires attorney fees be awarded to an employee whose employer was found to have violated this act (Sec. 3).

  • Prohibits an employer from reducing the wage of an employee in order to comply with this act (Sec. 3).

  • Prohibits any employer from discharging, discriminating, or other wise retaliating against an employee who took action against them in order to invoke enforcement of this act (Sec. 3).

  • Requires civil action be brought no later than 2 years after the day in which the employee knew or should have known their employer was in violation of this act (Sec. 4).

  • Establishes that this act shall take effect July 1, 2022 (Sec. 5).
