Vote to pass a bill that amends the special education conflict resolution process.

Highlights:

• Requires the department of education establish and maintain a list of employees that were physically injured while on the job by a student of the public school beginning June 30, 2022 (Sec. 1-3).

• Specifies that if the employee is forced to miss school then the department shall be required to report and document the specific causes that led to the employee missing work (Sec. 3).

• Prohibits a public school from providing information in the report that identifies the employee or the student (Sec. 3).

• Requires the school corporation or charter school to submit an agreement to the department detailing the types of issues identified by parents in due process proceedings and whether the issues are being addressed either explicitly or implicitly (Sec. 8).

• Establishes that a public agency shall have the burden of proof, including the burden of persuasion and production during mediation with parents and at a subsequent expedited due process hearings (Sec. 11).
