Highlights:

 

  • Requires private and public schools and districts designate athletic teams, activities, and sports for students in grades 6-12 as one of the following categories, including (Sec. 1):

  • Establishes that the sex of student for the purpose of determining eligibility to participate in an athletic activity or sport shall be determined by the students biological sex as indicated on the student’s original unedited birth certificate (Sec. 1).

  • Prohibits an athletic activity or sport designated for girls in grades 6-12 from being open to members of the male sex (Sec. 1).

  • Requires public and private postsecondary education institutions to designate intercollegiate and intramural athletic teams, activities, sports, and events as one of the following categories, including (Sec. 2):

    • Mens;

    • Coed; or

    • Womens.

  • Prohibits public and private postsecondary education institutions that is a member of the national intercollegiate athletic association (NCAA) from allowing a member of the male sex from competing in any intercollegiate or intramural athletic team, activity, sport, or event that is designated for women (Sec. 2).

  • Prohibits a government entity, licensing or accrediting organization, or an athletic association or organization from entertaining a complaint, or opening an investigation against a public or private school, or a postsecondary education institution for maintaining separate leagues and events for boys/men and girls/women (Sec. 2).
