Title: FAIR Act of 2022
Vote to pass a bill that prohibits a predispute arbitration agreement from being valid or enforceable if it requires arbitration of an employment, consumer, antitrust, or civil rights dispute.
Prohibits a predispute arbitration agreement from being valid or enforceable if it requires arbitration of an employment, consumer, antitrust, or civil rights dispute (Sec. 2).
Defines “antitrust dispute” as a dispute arising from an alleged violation of antitrust laws or state antitrust laws (Ch. 5, Sec. 501).
Defines “civil rights dispute” as the following, including (Ch. 5, Sec. 501):
An alleged violation of the Constitution of the United States or the Constitution of a state;
Any federal, state, or local law that prohibits discrimination on the basis of race, sex, age, gender identity, sexual orientation, disability, religion, national origin, or any legally protected status in
Education:
Employment:
Credit:
Housing;
Public accommodations and facilities;
Voting;
Veterans or service members;
Healthcare; or
Any program funded or conducted by the federal government.
Defines “consumer dispute” as a dispute between one or more individuals in which one seeks to acquire real or personal property, services (including digital technology), securities, or other investments, money, or credit for personal, family, or household purposes (Ch. 5, Sec. 501).
Defines “employment dispute” as a dispute between one or more individuals relating to a work relationship or prospective work relationship, including a dispute regarding the terms of, or payment for (Ch. 5, Sec. 501).
Defines “predispute arbitration agreement” as an agreement to arbitrate a dispute that has not yet arisen at the time of the making of the agreement (Ch. 5, Sec. 501).
