Title: Prohibits "No-Rehire" Clauses in Settlement Agreements
A vote to pass a bill that prohibits the use of "no-rehire" clauses in settlement agreements between employers and employees.
Specifies employee claims releases not enforceable if claims agreement restricts claimant from certain future work activity (General Obligations Law Sec. 5-338(2)).
Defines work activity as “applying for, accepting, or engaging in future employment with such employer, or any entity or entities related to such employer” (GOB 5-338(2)).
Specifies employer still bound by other provisions of claims agreement (GOB 5-338(2)).
