Title: Establishes Workplace COVID-19 Vaccine Exemptions

Vote to concur with house amendments and pass a bill that establishes workplace COVID-19 vaccine exemptions.

Highlights:

 

  • Requires employers relieve employees of COVID-19 vaccination mandate requirements under certain conditions, including (Sec. 1):

    • If the vaccine would be injurious to the health and well-being of the employee or prospective employee;

    • If the vaccine is in conflict with a sincerely held religious belief, practice, or observance of the employee or prospective employee; or

    • If the vaccine is in conflict with a sincerely held personal belief of the employee or prospective employee.

  • Requires employers pay for all COVID-19 workplace testing (Sec. 1).

  • Prohibits an employer from taking any adverse action against an employee or prospective employee who claims aforementioned relief (Sec. 1).

  • Prohibits an employer from keeping or maintaining a record or copy of an employee’s proof of vaccination, except under certain conditions (Sec. 1).

  • Defines “adverse action” as any action that results in the refusal to hire a potential employee or the termination of employment, demotion, or reduction in wages of an employee, and specifies that it does not include an employers reassignment of an employee, or ther termination of an employee if the reassignment is not practical (Sec. 1).

  • Specifies that the aforementioned provisions shall not apply to contracts for goods or services entered into before November 5, 2021, unless the contract is between an employer and their employees (Sec. 1).
