Title: Requires Mask Waivers for School Districts with Established Mask Mandates

Vote to pass a bill that requires mask waivers for school districts with established mask mandates.

Highlights:

 

  • Requires a school district, intermediate school district, or public school academy that implements a face mask policy to provide a waiver process through which a parent or legal guardian can submit that specifies their student shall not be required to wear a face mask to do any of the following, including (Sec. 1):

    • Enter or attend a school operated by the school district, intermediate school district, or public school academy;

    • Ride a school bus or other school-related vehicle; or

    • Participate in or attend a school-sponsored activity or event.

  • Prohibits a school district, intermediate school district, or public school academy from discriminating against a student in the following ways based solely on whether their parent or legal guardian has requested a waiver (Sec. 1):

    • Implementing segregated seating based solely on whether or not a student’s parent or legal guardian requested and received a waiver;

    • Requiring a student’s parent or legal guardian pay a different fee for admission into a school-sponsored event or activity; or

    • Prohibiting a student from participating in school-sponsored activities based solely on whether the student’s parent or legal guardian requested and received a waiver.
