Title: Amends Redistricting Maps

Vote to concur with Senate amendments and pass a bill that amends redistricting maps.

Highlights:

 

  • Specifies a reference to population is a reference to the population as determined by the most recent of the following (Sec. 1.a):

    • Federal decennial census;

    • Federal special census;

    • Special tabulation; and

    • Corrected population count.

  • Classifies "GIS" as the geographic information system maintained by the office that contains the following information (Sec. 4):

    • Geographic and population information provided in the official census report to the state by the United States Department of Commerce, Bureau of the Census, in reporting the 2020 decennial census of Indiana; and

    • Election history and supplemental geographic information compiled by the legislative services agency.

  • Classifies "house district" as a district of the House of Representatives of the general assembly described in (Sec. 5):

    • IC 2-1-12, before November 8, 2022; and

    • IC 2-1-14, after November 7, 2022.

  • Specifies if any part of Indiana is described as being in more than 1 house or senate district, the part is included within the house or senate district that (Sec. 7.b):

    • Is 1 of the house or senate districts in which the part is listed in:

      • IC 2-1-12 or IC 2-1-13, before November 8, 2022, whichever is applicable; or

      • IC 2-1-14 or IC 2-1-15, after November 7, 2022, whichever is applicable;

    • Is contiguous to the part; and

    • Contains the least population according to the 2020 decennial census of Indiana.

  • Requires the legislative services agency to separately maintain and preserve in the GIS the descriptions and maps included in the 2010 2020 decennial census of Indiana. The legislative services agency to make those descriptions and maps available for public inspection during regular office hours and on the Internet (Sec. 10).

  • Authorizes any court proceeding challenging a redistricting plan of the general assembly each of the Indiana house of representatives or the Indiana Senate to do the following (Sec. 12):

    • Take independent legal positions in the proceeding; and

    • Hire independent legal counsel to represent their respective legal positions.

  • Specifies if a redistricting act or any portion of a redistricting act is found invalid by a court, the general assembly expresses its preference that any court that finds the invalidity allows the general assembly to cure the invalidity before the court mandates its remedial plan (Sec. 12.d).

  • Specifies any part of Indiana that has not been described as included in a district is included within the district that (Sec. 19.a):

    • Is contiguous to the part; and

    • Contains the least population of districts contiguous to that part according to the 2020 decennial census of Indiana.
