Title: Requires Elections to Replace Trustees who are Recalled

Vote to pass a bill that requires elections to replace trustees who are recalled, or resign in the face of a recall.

Highlights:

 

  • Establishes the election of school district trustees including those in charter districts will be on the Tuesday following the first Monday in November in odd-numbered years (Sec. 1-1).

  • Requires an election for the recall of a school district trustee to be held on an election date authorized in section 34-106(9), Idaho Code (Sec. 1-4).

  • Requires a vacancy to be declared by the board of trustees when any nominee has been elected but has failed to qualify for office or within 30 days of when any trustee does the following (Sec. 2-1):

    • Dies; 

    • Resigns as trustee; 

    • Removes himself from his trustee zone of residence; 

    • They declare they are No longer a resident or school district elector of the district; 

    • Refuses to serve as trustee; 

    • Without excuse acceptable to the board of trustees, fails to attend 4 consecutive regular meetings of the board; or 

    • Are recalled and discharged from office as provided in law.

  • Specifies if a trustee is recalled from office or has resigned following the filing of a prospective recall petition with the county clerk and a vacancy is declared, the vacancy will be filled by an election held on the next available election date that is at least 85 days after the date on which the county clerk orders the election to be held (Sec. 2-5).

  • Specifies if the election will be held within 100 days of the date of the clerk's order to hold the election, the seat shall remain vacant until the election, after which the newly elected trustee will serve the remainder of the recalled trustee's term or, if the recalled trustee's seat was up for reelection on that election date, the newly elected trustee will serve the next full term of office (Sec. 2-5.a).

  • Specifies if the election to fill the recalled trustee's seat will be held more than 100 days from the date of the clerk's order to hold the election, a temporary trustee will be appointed to serve until a new trustee is elected (Sec. 2-5.b).
