Title: Authorizes the Legalization of Sports Betting

Highlights:

 

  • Specifies if a person's winnings at a casino facility or sports gaming facility are an amount for which reporting to the Internal Revenue Service of the amount that is required, a casino operator or sports gaming proprietor will deduct and withhold municipal income tax from the person's winnings at the rate of the tax imposed by the municipal corporation in which the casino facility or sports gaming facility is located (Sec. 718.031.B).

  • Requires a casino operator or sports gaming proprietor to file an annual return electronically with the tax administrator of the municipal corporation in which the casino facility or sports gaming facility is located, indicating the total amount deducted and withheld during the preceding calendar year (Sec. Sec. 718.031.C-2).

  • Authorizes the attorney general to refuse to grant a license to the organization, to revoke or suspend the organization's license, or place limits, restrictions, or probationary conditions on the organization's license for a limited or indefinite period, as determined by the attorney general (Sec. 2915.08-2).

  • Prohibits a distributor from knowingly selling, offering to sell, or otherwise providing or offer to provide an electronic instant bingo system to any person for use in this state, or maintain, update, or repair an electronic instant bingo system, without first obtaining an electronic instant bingo distributor endorsement to the person's distributor license issued under this law (Sec. 2915.081.F-1).

  • Specifies "commission" means the Ohio casino control commission (Sec. 3772.01.J).

  • Authorizes the attorney general to refuse to grant a manufacturer license if they have good cause to believe that the person, officer, or partner has committed a breach of fiduciary duty, theft, or another type of misconduct, related to a charitable organization that has obtained a bingo license under this law (Sec. 2915.082.C-6).

  • Prohibits a charitable organization from conducting electronic instant bingo unless all of the following are true (Sec. 2915.14.A):

    • The organization is a veteran's organization or is a fraternal organization;

    • The organization is a veteran's organization or has received from the internal revenue service a determination letter that is currently in effect stating that the organization is, exempt from federal income taxation; or

    • The organization has not conducted a raffle using an electronic raffle machine.

  • Requires the commission to use the money in the problem sports gaming fund to pay the costs of program services to alleviate problem sports gaming in this state (Sec. 3772.062-2).

  • Establishes the Ohio casino control commission will have jurisdiction over all persons conducting or participating in the conduct of sports gaming authorized by this law, including the authority to license, regulate, investigate, and penalize those persons in a manner that is consistent with the commission's authority with respect to casino gaming (Sec. 3775.02.A).

  • Requires the commission to conduct a complete investigation of each applicant for a sports gaming license to determine whether the applicant meets the requirements of this law and of the commission's rules each time the applicant applies for an initial or renewed sports gaming license (Sec. 3775.02.F-2).

  • Prohibits a person from operating, conducting, or assisting in operating or conducting sports gaming in this state without first obtaining an appropriate sports gaming license from the Ohio casino control commission (Sec. 3775.03.A).
