Highlights:

 

  • Prohibits the registration of an elector from being considered inactive due to an elector not voting or updating the elector’s registration for any period of time (Sec. 2-1).

  • Specifies the registration of an elector will be considered active if the only reason for the registration of an elector being considered inactive is that the elector neither voted nor up-dated the elector’s registration for any period of time (Sec. 2-2).

  • Requires the county clerk to mail a notice to each elector (Sec. 3-1):

    • Whose registration is inactive as of the 75th day before the date of a primary election or general election;

    • Whose registration is considered inactive due to a non matching signature or a name change; and

    • For whom the county clerk has a valid and current mailing address.

  • Requires the notice to include the following (Sec. 3-2):

    • Inform the elector that the elector’s registration is currently inactive;

    • State the reason for the inactivation;

    • Contain information on how the elector can reactivate the elector’s registration; and

    • Be sent to the elector no earlier than 70 days and no later than 60 days before the election.

  • Authorizes the county clerk to mail a notice to each elector whose registration is inactive as of the 75th day before the date of an election other than a primary election or general election. Any notice the county clerk chooses to send under this law must comply with the requirements set forth (Sec. 3-3).

  • Specifies if a ballot is challenged because it is returned in an unsigned return identification envelope or because the signature of an elector on a return identification envelope does not match the signature in the voter registration record for the elector, the county clerk will mail to the elector a notice that describes the nature of the challenge (Sec. 4-1).

  • Authorizes the filing officer to disclose as a public record the following information about each elector whose ballot was challenged under this law (Sec. 4-3.b):

    • The name of the elector;

    • The residence addresses of the elector; and

    • The reason the elector’s ballot is being challenged.
