Title: Requires Drug Tests for Law Enforcement Officers Involved in Certain Critical Incidents While on Duty

Vote to pass a bill that requires drug tests for law enforcement officers involved in certain critical incidents while on duty.

Highlights:

 

  • Defines “officer-involved critical incident” as an incident that occurs in the performance of a law enforcement officer’s official duties in which the following occurs, including (Sec. 3):

    • When the actions of the law enforcement officer result in death or great bodily harm to the individual; or

    • When the law enforcement officer discharges a firearm at an individual.

  • Requires law enforcement agencies adopt written policies on drug and alcohol testing following an officer-involved critical incident that specify the following, including (Sec. 4):

    • That each law enforcement officer who is involved in an officer-involved critical incident submit to drug and alcohol testing following the incident;

    • That the drug and alcohol testing be completed as soon as practicable after an officer-involved critical incident; and

    • That the drug and alcohol testing include testing for the presence and concentration of the following substances:

      • Alcohol;

      • Amphetamines;

      • Cannabis or cannabinoids;

      • Opiates;

      • Cocaine;

      • Phencyclidine; and

      • Anabolic steroids.
