  • Authorizes an individual to file a petition to seal all criminal records if they complete the following, including (Sec. 1):

    • Completing all terms and conditions of the sentence imposed by the court;

    • Paid all monetary obligations and restitutions to all victims;

    • Had their charge subsequently dismissed or resulted in a not guilty verdict; 

    • Arrested for a criminal offense and no charges were filed;

    • Met the required time period following successful probation completion, including: or

      • 10 years for a class 2 or 3 felony;

      • 5 years for a class 4, 5, or 6 felony;

      • 3 years for a class 1 misdemeanor; and

      • 2 years for a class 2 or 3 misdemeanor;

    • Had their sentence discharged by the court.

  • Requires an individual to file a petition to seal a criminal record in the following ways, including (Sec. 1):

    • With the court in which the individual was convicted;

    • With the court in which an indictment, information, criminal citation, or complaint against the individual was filed;

    • With the court in which the individual had a first appearance if charges were not filed; or

    • With the superior court in the county where the individual was arrested.

  • Requires a court to wait 30 calendar days after receiving a petition before granting or denying a petition to seal an individual's case records unless it is established that both the prosecutor and victim do not object to the request (Sec. 1).
