Title: Amends Education Laws

Vote to amend and pass a bill that amends education laws.

Highlights:

 

  • Authorizes the state board of education to issue subpoenas to compel the attendance and testimony of witnesses and production of evidence in connection with an investigation or hearing of an allegation that a certificated person has engaged in unprofessional conduct (Sec. 5).

  • Prohibits attendance boundaries from being used to require students to attend certain schools based on the student’s place of residence (Sec. 10).

  • Prohibits a county, city, town, or school district governing board from requiring the use of face-coverings by students or staff during school hours and on school property (Sec. 12A).

  • Prohibits a school district or charter school from requiring a student or teacher to receive a vaccine for COVID-19 or to wear a face covering to participate in in-person instruction (Sec. 12B).

  • Requires the department of education to provide to the state board of education access to the educator information system to investigate allegations of conduct for disciplinary actions (Sec. 13E).

  • Requires funding to be provided for a student in grade 9 if the student reaches the 40th day of grade 11 and meets the requirements (Sec. 14W).

  • Authorizes age-appropriate child assault awareness and abuse prevention (Sec. 21).

  • Prohibits teachers or administrators from allowing instruction on the following concepts (Sec. 21B):

    • One race, ethnic group, or sex being inherently, morally, or intellectually superior to another;

    • An individual, by virtue or by their race, is inherently racist, sexist, or oppressive;

    • An individual should be discriminated against because of their race, ethnicity, or sex;

    • An individual, by virtue of their race, ethnicity, or sex, bears responsibility for actions committed by other members of their race, ethnic group, or sex; and

    • Academic achievement or traits of a hard work ethic were created by members of a particular race, ethnic group, or sex to oppress members of other groups.

  • Requires the department of administration to develop an easily accessible school financial transparency portal including the following school level date beginning in fiscal year 2021-2022 (Sec. 23):

    • Detailed total revenues generated by weighted student count;

    • The total allocated federal, state, and local revenues;

    • The amounts allocated for teacher pay and benefits, classroom supplies, student support, and other expenditures; and

    • A comparison of the funding information for each school concerning the funding information for other schools in the same local education agency.

  • Authorizes a school district to use a portion of its transportation funding allocated to provide instead of transportation grants to parents of students who attend the school district (Sec. 31A).
