Title: Prohibits Transgender Athletes from Participating on Sports Teams that do Not Match their Birth Gender

Vote to pass a bill that prohibits transgender athletes from participating on sports teams that do not match their birth gender.

Highlights:

 

  • Prohibits an interscholastic athletic team sponsored or authorized by a school district or open-enrollment charter school from allowing a student to compete on the team in an interscholastic athletic competition sponsored or authorized by the district or school that is designated for the biological sex opposite to the student’s biological sex as correctly stated on (Sec. 1.a):

    • The student’s official birth certificate; or

    • If the student’s official birth certificate is unobtainable, another government record.

  • Authorizes an interscholastic athletic team to allow a female student to compete in an interscholastic athletic competition that is designated for male students if a corresponding interscholastic athletic competition designated for female students is not offered or available (Sec. 1.b).

  • Requires the University Interscholastic League to adopt rules to implement this law, provided that the rules are approved by the commissioner (Sec. 1.d).

  • Authorizes a student who attends a school district or open-enrollment charter school that sponsors or authorizes an interscholastic athletic team that violates this law to bring a civil action against the district or school if the student is directly harmed by the violation. The student may obtain (Sec. 1.e):

    • Injunctive relief; and

    • Court costs and reasonable attorney’s fees.

  • Establishes a statement of a student ’s biological sex on the student ’s official birth certificate is considered to have correctly stated the student ’s biological sex only if the statement was (Sec. 2.d):

    • Entered at or near the time of the student’s birth; or

    • Modified to correct a clerical error in the student’s biological sex.
