Vote to concur with Senate amendments and pass a bill that amends the date of local elections due to delay of release of redistricting data from the Census and the COVID-19 pandemic.

Highlights:

 

  • Requires the regular 2021 elections in any municipality where there is an election of municipal officers scheduled for 2021 to be delayed until 2022 (Sec. 1A).

  • Prohibits revisions of 2020 Census Data and any resolution adopted under that statute from being applied to any election delayed in 2022 (Sec. 1B).

  • Authorizes any person who has filed a notice of candidacy for any elected office with an election delayed to 2022 to withdraw their candidacy (Sec. 1D).

  • Requires the following dates of elections for any municipality elected by the following (Sec. 1E):

    • The partisan primary shall be held on March 8, 2022, and the general election shall be on the date of any second primary. If there is no second primary, the date shall be on April 26, 2022;

    • The nonpartisan primary shall be held on March 8, 2022, and the general election shall be on the date of any second primary. If there is no second primary, the date shall be on April 26, 2022:

    • The nonpartisan plurality method shall be held on March 8, 2022; and

    • The nonpartisan elections and runoff method shall be held on March 8, 2022, and the runoff shall be held on the date of any second primary. If there is no second primary, the date shall be on April 26, 2022.

  • Requires the winner of the 2021 election to hold office until the expiration of the term (Sec. 1F).

  • Authorizes the winner of the 2022 election to be sworn into office any time after the election is certified (Sec. 1F).

  • Requires the board of county commissioners to review and revise its electoral districts following State and federal law, and adopt a resolution with the revised electoral districts on or before November 17, 2021 (Sec. 1.4).

  • Requires the second primary to be held 10 weeks after the first primary if the position is for the office of the United States Senate or House of Representatives, otherwise, it shall be held seven weeks after the first primary (Sec. 1.5A).

  • Requires the Charlotte-Mecklenburg Board of Education to adopt a resolution that the next election will occur at the time of the 2022 general election if census information is not received by July 19, 2021 (Sec. 1.6B).

  • Requires Lexington City Board of Education members to hold over in office until their successors are elected from the general election taking place in 2022 (Sec. 1.7A).

  • Requires the Lexington City Board of Education to adopt a resolution that the next election will occur at the time of the 2022 general election if census information is not received by July 19, 2021 (Sec. 1.7B).

  • Requires the election of City Council and Mayor of Raleigh to comply with the following (Sec. 1.8A):

    • The method of election will be a nonpartisan plurality method; and

    • Elections shall be held in even-numbered years.

  • Prohibits municipal elections from being conducted in Raleigh in 2021 and extends the terms of Mayor and all Council members to be extended until their successor is elected (Sec. 1.8B).

  • Requires Raleigh to review and revise its electoral districts to comply with State and federal law before March 31, 2022, and deliver them to the county boards of elections no later than March 31, 2022 (Sec. 1.8C).
