Highlights:

 

  • Authorizes non-commercial, personal use and sharing of specified controlled substances for counseling or healing services (Sec. 1).

  • Prohibits any person without a written prescription from a physician, dentist, podiatrist, or veterinarian licensed to practice in the state from possessing any controlled substance, or else they shall be imprisoned for no more than one year except if (Sec. 4):

    • The possession of the controlled substance was authorized by the prescription holder; or

    • The sole intent of the possession is to deliver it to the prescription holder or discard it lawfully.

  • Authorizes any person 21 years of age or older to possess, process, obtain, or transport mescaline for personal use or social sharing (Sec. 5).

  • Establishes a misdemeanor punishment if any person 21 years of age or older possesses mescaline on public or private elementary, vocational, junior high, or high school grounds at any time when minors are using the facilities (Sec. 5).

  • Establishes a fine of $500 or imprisonment in county jail for no more than 6 months if mescaline is administered to anyone 18 years of age or younger (Sec. 5).

  • Establishes an imprisonment period of 3, 5, or 7 years if any person 18 years of age or older knowingly gives or administers mescaline to a minor under 14 years of age (Sec. 5).

  • Establishes an infraction for any person who gives or administers mescaline to a person who is at least 18 years of age and under 21 years of age (Sec. 5).

  • Prohibits possession of an opium pipe or any device used to unlawfully inject or smoke a controlled substance (Sec. 6).

  • Establishes a misdemeanor for any person who unlawfully delivers, furnishes, or transfers drug paraphernalia with the intent to deliver, furnish, or transfer it, knowing that a person would use it (Sec. 7).

  • Prohibits any person from visiting or being in a place where controlled substances are being unlawfully smoked or used with the knowledge that it is occurring (Sec. 8).

  • Authorizes all of the following for a person 21 years of age or older involving methylenedioxymethamphetamine or MDMA (Sec. 15):

    • The possession, processing, obtaining, or transporting of MDMA for personal use or social sharing;

    • The ingesting of MDMA; or

    • The social sharing of MDMA.

  • Establishes a fine of $500 or imprisonment in county jail for no more than 6 months if a person knowingly gives away or administers MDMA to a person under 18 years of age (Sec. 15).

  • Establishes a punishment of imprisonment if a person over 18 years of age knowingly gives away or administers MDMA to a minor under 14 years of age (Sec. 15).

  • Establishes an infraction for any person who knowingly gives or administers MDMA to a person who is at least 18 years of age and under 21 years of age (Sec. 15).

  • Prohibits any person from being under the influence of controlled substances, except when approved or prescribed by a person licensed by the state to prescribe, dispense, or administer the controlled substance (Sec. 16).
