Vote to amend and pass a bill that authorizes outdoor college football stadiums to open to 100% capacity during the COVID-19 pandemic.

Highlights:

• Authorizes a stadium located on the campus or property of a constituent institution of The University of North Carolina or a private postsecondary institution, to be permitted to operate at 100% of the occupancy limits established according to the North Carolina State Building Code (Sec. 1).

• Authorizes and empowers the governor to close any individual stadium only as follows (Sec. 2):

• The Governor may order, by executive order, an individual stadium to close, restrict, or reduce operations within the individual stadium when necessary to protect the health and safety of athletes, staff, and attendees.

• For any order issued as provided in subdivision (1) of this section, the Governor shall provide reasons specific to that individual stadium for requiring closure, restriction, or reduction in the operation of the individual stadium. The Governor may require such actions for any reason deemed necessary by the Governor.

• The Governor may only restrict, by executive order, an individual stadium and shall not order a statewide closure, restriction, or reduction of the operation of stadiums identified in Section 1 of this act in a single executive order.

• The Governor shall not use the authority granted in Article 1A of Chapter 166A of the General Statutes, or any other provision of law other than the authority granted by this section, to direct the statewide closure, restriction, or reduction of the operation of a stadium identified in Section 1 of this act.

• Specifies this act applies only to Cumberland County, Durham County, Forsyth County, Guilford County, Harnett County, Jackson County, Mecklenburg County, Orange County, Pasquotank County, Pitt County, Robeson County, Wake County, and Watauga County (Sec. 3).
